🤝 Clear & Honest Work Agreement

At WebJugaad, we operate with full transparency. We agree on project scope, milestones, and deliverables upfront. Once full payment is completed, you own the website deliverables created for your business.

1Acceptance of Terms

By browsing our website (webjugaad.com), requesting a project quote, or commissioning any web development, web application, or custom business software service from WebJugaad ("we," "us," or "our," managed by Kapil Kumar), you agree to be bound by these Terms and Conditions.

If you do not agree with any part of these terms, please do not use our website or hire our services.

2Services & Scope of Work

WebJugaad provides tailored web and software solutions including but not limited to:

  • Custom Business Websites: Fast, mobile-responsive showcase websites, landing pages, and multi-page business portals.
  • Web Applications: Tailored web apps, client dashboards, booking systems, and interactive tools.
  • Custom Business Software: Bespoke digital workflows, order management, inventory tracking, and billing modules.
  • Local SEO & WhatsApp Integration: Search engine optimization, Google Business Profile setups, and click-to-WhatsApp catalog funnels.

Each engagement will have an agreed-upon scope of work detailed in a proposal, invoice, or official message exchange before development begins. Any work requested outside the initial agreed scope may be subject to additional charges and revised timelines.

3Client Responsibilities

To ensure timely and successful delivery of your project, you agree to:

  • Provide necessary business materials (logos, product photos, service details, price lists, and textual content) in a timely manner.
  • Ensure you have the legal right or license to use any images, trademarks, logos, or content provided to us for inclusion on your website.
  • Review drafts and deliverables promptly and provide consolidated feedback during the review stages.
  • Maintain the confidentiality of administrative credentials, API keys, or access logins provided to you upon project handover.

4Pricing, Payments & Milestones

  • Advance Deposit: Unless otherwise agreed in writing, projects require an advance deposit (typically 50%) before design and development kickoff.
  • Final Balance: The remaining balance is due upon project completion, demonstration of working features, and prior to final deployment on your live domain or source transfer.
  • Third-Party Recurring Costs: Recurring expenses like domain registration renewals, premium third-party APIs, or specialized hosting infrastructure remain the direct responsibility of the client unless bundled in a specific ongoing maintenance agreement.
  • Refunds: Payments made for completed development work or custom design phases are non-refundable once the milestones have been initiated or approved.

5Intellectual Property & Ownership

Upon receipt of full payment for the project:

  • Client Ownership: You own full rights to the specific customized website design, bespoke copy, and final deliverables created for your business.
  • WebJugaad Portfolio Rights: We reserve the right to showcase screenshots, live previews, and case study descriptions of the completed website in our portfolio and marketing materials, unless an explicit non-disclosure agreement (NDA) has been executed.
  • Open-Source & Frameworks: Underlying open-source libraries, frameworks (e.g. Astro, Tailwind CSS), and reusable helper utilities remain licensed under their respective open-source licenses.

6Revisions & Post-Launch Support

We provide revision rounds during active development as outlined in your project agreement to ensure the final product meets your specifications.

Following final project launch, we include a complimentary post-launch support window (typically 14 to 30 days) to address any technical bugs or unforeseen layout issues. Ongoing maintenance, major feature additions, or recurring updates after the warranty window can be handled under a flexible maintenance retainer.

7Limitation of Liability

While we build reliable, secure, and modern applications following industry standards:

  • WebJugaad shall not be liable for any indirect, incidental, consequential, or punitive damages resulting from website downtime, server outages caused by third-party hosting providers, cyberattacks, or client modifications made to source code.
  • We do not guarantee specific sales figures, search rankings, or commercial outcomes, as business performance depends on numerous market factors outside our control.
  • Our maximum aggregate liability for any claim arising out of a project shall not exceed the total amount paid by the client for that specific service engagement.

8Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Uttar Pradesh and the Republic of India. In the event of any dispute, both parties agree to first make a good-faith effort to resolve the matter through amicable consultation and mediation.

9Modifications to Terms

We reserve the right to revise or update these Terms and Conditions at any time. Any changes will be posted on this page with an updated timestamp. Continued engagement of our services after updates constitutes acceptance of the new terms.
